Pristiva® Perfect Pool Guarantee

 (Manufacturer’s Limited Warranty)

Consumer Terms & Conditions

 

Here is what the guarantee covers:

When used as directed, and subject to the terms and conditions provided herein, Pristiva guarantees the following:

  • Algae free swimming pool water*
  • No scale on pool finishes below the water line
  • Prevention of stains on pool finishes below the water line
  • Clear pool water (no cloudy water)
  • Pristiva products are made only with pristine Nova Scotia salt

*Pristiva’s Activator and Primer® are not algicides or algistats and do not kill algae. Normal sanitizer levels prevent algae growth. 

Here is what Pristiva will do:

If you experience problems with algae, scale, stains, or cloudy pool water after the prescribed use of Pristiva products in accordance with the instructions on the product label and this guarantee, Pristiva will provide you with such curative products as are recommended by your participating Pristiva retailer (up to a maximum $100 retail value) to remedy your problem.  Your Pristiva retailer shall select approved curative products to ensure compatibility with your Pristiva salt water pool.

Pristiva Perfect Pool Guarantee conditions:

This guarantee:

  1. Applies only to residential, in-ground or above-ground pools with volumes between 8,000 and 40,000 gallons.
  2. Does not apply where: calcium hardness of your pool water exceeds 400 ppm; or where water balance or operational parameters are not in line with the recommendations of the pool’s ECG (electrolytic chlorine generator) manufacturer; or to pre-existing conditions (e.g. visible algae, discoloration on finishes, chlorine demand, rough finishes, scale on ECG cell, broken equipment, etc.). Customers who have a pre-existing condition and choose not to resolve it, will not qualify for the guarantee with the following exception. Pools with pre-existing scale or staining that cannot be corrected may still participate in the guarantee but will be excluded from stain or scale coverage.
  3. Requires your pool water to first be tested by your participating Pristiva retailer and all necessary adjustments recommended by the Pristiva retailer to be made prior to applying Pristiva products.
  4. Covers only stain and scale to smooth swimming pool finishes below the water level (rough finishes due to etching or scaling are excluded).
  5. Requires application of minimum quantities of Pristiva products based on the gallon size of your pool as prescribed by your Pristiva retailer. Pristiva Activator should be applied in the deep end of the pool and not allowed to pile, and should be adequately brushed out to ensure rapid dissolution. The minimum quantities prescribed for a pool size of 8,000 gallons is as follows:
    1. For a new or refilled pool or traditional chlorine pool being converted to Pristiva: application of a minimum startup quantity of 5 bags (40 lb. size) of Activator and 1 bottle of Primer® must be applied to the pool. Salinity levels must be maintained according to your ECG manufacturer’s recommendations.
    2. For converted salt water pools: application of a minimum startup quantity of 1 bag (40 lb. size) of Activator and 2 bottles of Primer. Note: An initial sodium dicholor 'shock' should precede the use of Pristiva using 9 to 11 ozs. per 10,000 gallons of water.

To participate, please complete the registration supplied by your Pristiva dealer and then continuously:

  1. Maintain your pool with Pristiva products in accordance with the instructions on the label and this guarantee; replenish your pool with Activator whenever salinity levels are below the chlorine generator manufacturer’s recommended levels; and add Primer every 3 months for as long as you have your pool open.
  2. Maintain your pool’s water balance and chlorine levels according to ECG manufacturer’s recommendations.
  3. Maintain your pool’s sanitizer levels in accordance with your chlorine generator manufacturer’s instructions.
  4. Maintain your water circulation (pump) and filtration systems in proper working order and operate them in accordance with your manufacturer’s recommendations for proper water circulation and filtration or at least 6 hours a day.
  5. Have your pool water tested by your Pristiva retailer every 30 days and thereafter following the initial application of Pristiva products.
  6. Use only curative and maintenance pool products recommended by your participating Pristiva retailer.

How to register a warranty claim:

  1. Bring your dated purchase receipt showing proof of Pristiva purchase to your Pristiva retailer (the retailer location where you originally purchased the product) within 60 days of your last product purchase, along with a copy of your last pool water test and a representative sample of your pool water for testing. Water samples should be approximately one (1) quart, taken elbow deep in the pool and away from the return jets.
  2. After your Pristiva retailer tests your pool water and confirms your qualifications with the conditions of this guarantee, your Pristiva retailer will review your claim.   
  3. If your Pristiva retailer determines your claim qualifies for the guarantee under the specified terms and conditions, the curative products will be supplied by the Pristiva retailer to you free-of-charge up to $100 retail value. Your dealer has a list of recommended products that are compatible for use in a salt water pool and with Pristiva's unique formula.
  4. Whether you qualify under the guarantee is left to your Pristiva retailer’s discretion. Any questions concerning qualification under the guarantee may be directed to Pristiva at pristivaguarantee@gmail.com.

 

LIMITATION OF LIABILITY

Notwithstanding any other interpretation of the terms and conditions of this limited guarantee, your remedy, and the extent of Pristiva’s liability for any claims arising from or relating to the Pristiva Perfect Pool Guarantee, is limited solely to $100 retail value of curative products to be supplied by your Pristiva retailer.  Pristiva will not have any liability or responsibility for any other damages arising from or related to the alleged failure to meet the Pristiva Perfect Pool Guarantee. Failure to follow the terms and conditions prescribed in this guarantee and on the product label, the use of curative or other products not recommended by your Pristiva retailer, or the use of recommended products in a manner other than that prescribed by your Pristiva retailer, will void this warranty.

THIS GUARANTEE IS INTENDED TO REPLACE ALL OTHER GUARANTEES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL PRISTIVA BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE PERFORMANCE, USE, MISUSE, OR INABILITY TO USE ANY PRISTIVA PRODUCTS, WITHOUT LIMITATION.

THIS GUARANTEE GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
